Terms of Agreement

Claims

Purchasers are advised to examine goods immediately upon receipt. In case of an alleged “damage on arrival” claim. API must be notified within 24 hours of receipt of goods.

Deliveries consignment notes must be endorsed for all “damaged on arrival” claims.

For all other alleged claims AP must be notified within 72 hours of receipt of goods.

This includes all stock claims based on product expiry.

After the 72 hour claim period has expired the purchase will be deemed a no return sale.

Returns

No goods are returnable without prior agreement by API. Failure to do this can result in a denied claim.

Good authorised to return must meet the following requirements:

  • Goods must be received back to API within 2 weeks of authorisation unless agreed otherwise by API
  • Product must be in unbroken, sealed outers or individual containers with a tamper evident seal (seals must be intact)
  • Batch numbers of returned goods must match those on the original despatch note
  • Goods must be in pristine condition and must not have been subjected to any extreme storage or handling conditions

All returns are to be supported by API Pro Forma Credit Note (available from an API Rep), or a Return Material Authorisation number (RMA) available from Customer Services

Ownership

Ownership of all goods supplied by API to the purchaser shall not pass the purchaser until API has received full payment of all monies owing by the purchaser.

Recovery of Goods

If the purchaser fails to pay for the goods on the due date, or commits an act of bankruptcy, or being a company that has a receiver appointed or goes into liquidation whether voluntary or otherwise API shall be entitled to recover possession of all goods supplied by it and for that purpose shall be entitled to enter the purchaser’s premises without prejudice to any other rights API may have

Freight

Where orders drop below a value of $200 a minimum freight charge of:

  • Local $5 (Bombay-Warkworth)
  • North Island $10
  • South Island $15
  • Additional charges will be incurred for special door to door deliveries
